International education has many benefits, recognized by students and educational institutes alike. However, the UK Home Office has continued to tighten immigration requirements relating to international students. It is essential for sponsors and students to keep up to date with Home Office policy and procedures in relation to Tier 4 of the Points Based System.
We can advise independent schools and colleges who would like to become new Tier 4 sponsor licence holders on the Home Office’s application process. Gaining a licence will enable schools to sponsor students from outside the EU for more than six months. Sponsors have an ongoing duty to report information, including student absences and withdrawals to the Home Office and we can provide clear guidance on your responsibilities.
Students applying for visas are subject to strict requirements including an assessment of whether they are a “genuine student” for all students over 16 years old. It is also very important for students to have the correct evidence of the funds required for their visits.
If visas are refused students do not have a right of appeal to a Tribunal but it may be possible to challenge the decision by way of Administrative Review.
We can provide advice and assistance in relation to:
- Tier 4 sponsor licences and compliance
- Tier 4 student visas
- Tier 4 dependent visas
- Short term study visas
- Administrative reviews
If you represent an independent school or college and would like a review of compliance procedures, please get in touch for a confidential and no obligation discussion as to how we can assist you.
